Privacy Policy and Terms of Use

Privacy Policy

1. Basic policy
Universal Support Systems, Ltd. (hereinafter “USS”) shall respect the privacy of you as the person using the Online Application System (hereinafter the “User”), and shall handle the personal information of the User (as defined below) appropriately in accordance with the following standards, based on the recognition that protecting such personal information is a key responsibility.
2. Definition of personal information
In this Policy, “Personal Information” shall refer to information pertaining to the User as an individual, including information that can be used to identify the User as an individual, such as name, address, telephone number, e-mail address, and school name. Such Personal Information shall also include information that alone cannot be used to identify the User, but can easily be combined with other information in order to effectively identify the User as an individual.
3. Purposes of use of Personal Information
  • The purposes of use of Personal Information within the Online Application System shall be as stated below. Personal Information that USS has acquired shall be used within the scope of the purposes of use that have been indicated in advance, with the exception of cases in which a separate notification is given regarding a purpose of use, etc.
  • *Providing services to Online Application System users, and universities, vocational schools, and other educational institutions that are using the Online Application System
  • *Authenticating registered users within the Online Application System
  • *Sending out notices and news (including some advertisements) from USS and educational instructions that are using the Online Application System
  • *Implementing questionnaires and creating and disclosing statistical data
  • *Responding to inquiries, etc.
  • *Carrying out smooth operations of the Online Application System
4. Optional nature of providing Personal Information and result of not providing such information
The provision of Personal Information to the Online Application System is optional. Nevertheless, during the implementation of services via the Online Application System, various services many be unavailable unless the required fields are filled out.
5. Changing, etc. of Personal Information
The User shall be able to view, change, add to, and delete his/her Personal Information registered on the Online Application System at any time.
6. Providing Personal Information to third parties
  • In principle, the Personal Information of the User shall not be provided to any third parties without his/her consent. Such provision shall only take place if the receiver and content of the information to be provided have been indicated to the User and then he/she has given consent. Nevertheless, there may be cases in which the Personal Information of the User is disclosed or provided to a third party if such provision is permitted by law, such as the cases indicated below.
  • *USS has determined that without disclosure or provision, the User will create a disadvantage for a third party.
  • *Disclosure or provision is necessary to protect human life, body, or property, and it is difficult to obtain the consent of the User.
  • *Disclosure or provision is especially necessary to improve public hygiene or to promote the healthy development of children, and it is difficult to obtain the consent of the User.
  • *Disclosure or provision is necessary to cooperate with a national institution, local public organization or a party entrusted by a national institution or local public organization in order to execute legal duties, and there is a risk that obtaining consent from the User will interfere with the execution of the such duties.
  • *A court, public prosecutor, police officer, bar association, or consumer information center, or other organization with commensurate authority, has requested the disclosure of Personal Information.
  • *The User has explicitly requested disclosure or provision to a third party.
  • *Disclosure or provision is permitted by law.
7. Scope of third parties
  • In the following cases, entities receiving the provision of Personal Information shall not constitute third parties.
  • *USS has entrusted all or part of the handling of Personal Information to a third party to the extent necessary for the achievement of the purposes of use of the Personal Information. In such cases, USS shall bear responsibility regarding the Personal Information protection policy of the entrusted party.
  • *Personal Information has been provided to a third party accompanying the succession of business operations due to a merger involving USS or other circumstances.
8. Disclaimer
  • USS shall not bear any responsibility regarding the acquisition of personal information by a third party in the following cases.
  • *The User has personally revealed Personal Information to a specified third party by using a function of the Online Application System or other means.
  • *A third party was able to identify the User by chance based on the User’s application information or information that another user entered into the Online Application System.
  • *The User provided Personal Information to, or used Personal Information on an external website linked with the Online Application System.
  • *A person other than the User acquired information that could be used to identify the User (user ID, password, etc.).
9. Management of Personal Information at educational institutions using Online Application System
Personal Information shall be provided to the extent necessary for the use of the Online Application System by educational institutions. At relevant educational institutions, the handling of Personal Information shall be managed in accordance with their regulations regarding such. Nevertheless, in contracts between USS and such educational institutions, the only purpose of use of Personal Information stipulated shall be “application operations.” Relevant educational institutions shall access Personal Information through operation of the Online Application System.
10. Outsourcing
USS may in some cases outsource all or some of the handling of Personal Information. In the case of carrying out outsourcing, contractors shall be selected based on the criteria that they can ensure a sufficient level of protection regarding Personal Information, and outsourcing shall only be carried out after an agreement regarding the protection of Personal Information has been concluded with such contractors. Furthermore, management at such contractors shall be supervised as necessary in an appropriate manner.
11. Use for statistical data
Based on Personal Information that has been provided, USS may in some cases create statistical data that has been processed in a way that makes users unidentifiable. USS shall be able to use this statistical data in which users are unidentifiable, in an unrestricted manner. In such cases, the relevant copyrights shall belong to USS.
12. Confirmation of identity
In situations such as responding to requests regarding disclosing, revising, deleting, or stopping the use of Personal Information, USS shall confirm that the person making the request, etc. is the User based on information that enables the checking of identity (name, address, telephone number, e-mail address, user ID, password, etc.). USS shall not bear responsibility in cases in which a person other than the User has used the User’s information that enables the checking of identity.
13. Management of Personal Information
USS shall make an effort to continuously take the necessary and appropriate safety measures in terms of technologies and organizations, with regard to unauthorized access to Personal Information and dangers such as the loss, destruction, falsification, and leakage of Personal Information. Furthermore, USS shall observe laws and ordinances, industry standards and norms, and public order and morals regarding the protection of Personal Information.
14. Changes to Privacy Policy
USS shall make an effort to continuously revise and improve this “Policy on the Protection of Personal Information (Online Application System).” In doing so, changes may be made without notice being given to the User. Nevertheless, the consent of the User shall be obtained before changes are made to purposes of use.
15. Inquiries regarding changing of Personal Information, etc.
  • The procedures related to inquiries from Users regarding Personal Information shall be as follows.
  • The User should log into the system via the “top page” using his/her user ID and password, and then proceed to the “change settings” screen. The User will then be able to independently carry out operations for the changing of, adding to, and deleting of content.
  • In the case of inquiries regarding Personal Information, the User should use the “opinions and inquires form.” USS shall provide notification to the User regarding the relevant procedures, etc. within about one week.
16. Use of cookies
Within the Online Application System, cookies shall be used in order to protect the Users privacy, enhance convenience, and enable the transmission of advertisements and acquisition of statistical data. Such cookies shall never contain Personal Information.
17. Encrypted communication function
For the Online Application System, USS has adopted an encrypted communication function (SSL), etc. in order to protect Personal Information, and is taking thorough measures to protect information and ensure security. Based on the use of such functions, USS shall make it possible to receive information from the User while preventing any infringement of the User’s privacy.

Terms of Use

◆ Article 1 (Online Application System)
The “Online Application System” (hereinafter referred to as the “System”) shall collectively refer to various types of information services targeting you as a user of such services (hereinafter referred to as the “User”), and universities, vocational schools, and other educational institutions using such services (hereinafter referred to as the “Schools”), that consist of services within the System provided by Universal Support Systems, Ltd. (hereinafter referred to as the “USS”) on the internet, such as application form submission (hereinafter referred to as “Application Submission”), settlement of the related entrance examination fee (hereinafter referred to as “Application Fee”), and the transmission of information.
◆ Article 2 (Use of Online Application System)
  • Upon using the System, the User is deemed to have consented to all content of the “Online Application System Terms of Use” (hereinafter referred to as the “Terms”) and the “Policy on the Protection of Personal Information (Online Application System).” If the User indicates that he/she does not consent to the Terms, it shall be deemed that he/she will not be using the System, and therefore, the User shall be unable to use the System without consenting to the Terms.
  • Upon using the System, the User shall be deemed as doing so at his/her own will and shall bear responsibility for doing so.
◆ Article 3 (User)
  • The User shall refer to you as a person using the System for Application Submission to the Schools using the System, who has registered information that enables identification as an individual (hereinafter referred to as “Personal Information”) and the required information for Application Submission (hereinafter referred to as “Application Information”), and whose registration of such information has been approved by USS.
  • The User shall carry out user registration regarding the System at his/her own will, and shall only be able to use the System at his/her own will and responsibility.
  • The User shall bear responsibility regarding the content of Personal Information, Application Information, and other information that he/she has input during user registration.
  • The User shall be able to revise, delete, and add to Personal Information and Application Information that he/she has registered during user registration via his/her dedicated web page on the System.
  • In the case that USS has determined that the User has violated the Terms, USS shall be able to revise and delete the User’s registered content without giving any notification to the User in advance.
  • The User shall use and manage the user ID and password that he/she has registered, or the “My Page” URL that USS has issued for him/her at his/her own responsibility, and shall not allow use of such by, or transfer such to, a third party under any circumstances.
◆ Article 4 (Changing services, etc.)
  • USS may in some cases change or temporarily suspend the services of the System without giving notification to the User in advance.
  • USS shall be able to carry out the long-term suspension or termination of the provision of all services after notifying users of such at least three months in advance.
◆ Article 5 (Prohibited acts for User)
  • Within the System, the User shall not engage in acts that correspond, or may correspond, to the following.
  • (1) Double registering, or registering false information or the information of another person
  • (2) Violating the copyrights and other intellectual property rights, privacy, or other rights of USS or a third party
  • (3) Engaging in discrimination, criticism, attacks, or slander with regard to USS or a third party
  • (4) Interfering with the business operations of USS or a third party
  • (5) Making offensive statements or engaging in violent behaviors, or carrying out acts similar to such
  • (6) Engaging in acts that cause a disadvantage to USS or a third party other than those above
  • (7) Engaging in commercial activities
  • (8) Engaging in political, campaigning, or religious activities, or activities similar to such
  • (9) Engaging in acts that violate laws and ordinances, criminal acts, or acts that violate public order and morals
◆ Article 6 (Responsibilities and guarantees of USS)
  • USS shall not bear responsibility for damages incurred by the User or third parties resulting from use of the System, except in cases of willful misconduct or gross negligence on the part of USS. Nevertheless, in cases in which USS bears responsibility for damages, this shall only be in regard to direct and ordinary damages.
  • USS shall not bear any responsibility regarding damages that have been incurred as the result of circumstances beyond the control of USS that could not be prevented with security measures that ordinarily need to be taken, such as malicious computer viruses, cyberattacks, natural disasters and computer system failures that have occurred in spite of the taking of preventive measures.
  • The User hereby consents to the fact that recruitment information and application-result information provided by the Schools via the System, electronic files attached using message-sending functions, and so on are provided at the responsibility of the relevant Schools, and USS does not provide any guarantees regarding the content of such information provided by the Schools, and the User shall use such content at his/her own responsibility.
  • In the case that a third party has incurred damages due to use of the System by the User, the User shall resolve matters in this regard at his/her own responsibility, and USS shall not bear any responsibility for doing so.
  • In the case of use of the System by the User, USS shall not guarantee the certainty of application results associated with use that is not in accordance with ordinary processing procedures.
◆ Article 7 (Use of registered information)
  • Information that has been registered during user registration shall be used for the provision of services to the User and the Schools within the System and for authentication.
  • After the User has carried out user registration, he/she shall be deemed to have consented to receiving e-mails send out as needed by USS, and allowing messages from USS and the Schools to be displayed on his/her personal screens within the System.
◆ Article 8 (Intellectual property rights)
  • All intellectual property rights regarding contents within the System shall belong to USS and shall be protected under the Copyright Act, Trademark Act, Design Act, and so on. Nevertheless, this shall not apply in the case of documents, photographs, videos, and so on that have been created by the information provider or by an entrusted party of the information provider.
  • USS may in some cases implement various types of questionnaire surveys, campaigns, respondent recruitment, and so on regarding the User. USS shall be able to reprint content, such as opinions and information that the User has personally posted on the System in information publications, magazines, online copyrighted materials, and so on issued by USS, without obtaining consent from the User in advance.
  • With the exception of information that can be used to identify the User, USS shall be able to process the User’s registered information and use it in various types of media and so on edited and issued by USS.
  • Based on Paragraph 2 and Paragraph 3 of this article, copyrights and all other rights associated with the abovementioned information created by USS shall belong to USS.
◆ Article 9 (User withdrawal and expulsion)
  • The User shall be able to freely delete his/her registration via the screen for making changes to registration within the System. In the case of carrying out procedures for deleting registration, these must be carried out independently by the User via the abovementioned screen.
  • In the case that USS has determined that the User has violated the Terms, USS shall be able to expel or temporarily suspend the User from the System without giving any notification to the User in advance.
  • USS shall delete all registered information after a certain period of time following the end of the fiscal year.
◆ Article 10 (Handling of Personal Information)
The User shall be deemed to have read and consented to the policy of USS regarding the handling of Personal Information (Online Application System) before he/she uses the System.
◆ Article 11 (Changes to Terms of Use)
USS shall be able to change, added, and delete the provisions of the Terms as needed without obtaining consent from the User. All Users shall be deemed to have consented to the content of such changes after they have been reflected within the System for a period of one month.
◆ Article 12 (Agreed jurisdiction)
The Terms shall be governed by the laws of Japan, and the court of first instance regarding the Term shall be Tokyo District Court or Tokyo Summary Court.
